These Terms and Conditions (the "Agreement") govern the use of the services and products offered by Smilehostie, a leading web hosting and domain registration service provider. By accessing or utilizing the services of Smilehostie through our website, you hereby acknowledge and accept the full extent of these Terms and Conditions. If you disagree with any of the terms and conditions outlined herein, you must immediately cease using our website and services. This Agreement constitutes a legally binding contract between you (the "Client" or "You") and Smilehostie (the "Company," "We," "Us," or "Our"). It is your responsibility to read and understand all terms presented, as they are subject to modification at the discretion of the Company.

1. Domain Registration

The process of domain registration through Smilehostie may take a duration of 24 to 48 hours for activation, depending on several factors, including but not limited to registrar processing times, DNS propagation, and third-party registry delays. While we strive to expedite this process, unforeseen issues may occasionally cause delays. In the event that a domain registration fails or is not successfully activated, we offer a full refund for the domain registration amount, in accordance with our refund policies. It is important to note that Smilehostie acts as a third-party domain registrar and performs registrations through external service providers; therefore, we have no direct control over certain elements of the domain activation process.

2. Hosting Service Refund Policy

Smilehostie offers a 7-day money-back guarantee exclusively for our hosting services. This guarantee allows Clients to request a full refund for hosting services within seven (7) calendar days of the initial purchase, without the need for justifying the reason for cancellation. The guarantee is strictly limited to hosting services and does not extend to domain registrations, renewals, transfers, or other ancillary services. Any refund requests made after the 7-day period will not be honored. By purchasing hosting services from Smilehostie, you acknowledge and agree to the terms of this refund policy. Please be advised that the 7-day money-back guarantee is offered once per Client account, and any subsequent purchases made after the initial refund will not be eligible for this guarantee.

3. Fair Usage Policy for Unlimited Plans

Our "Unlimited" hosting plans come with a Fair Usage Policy that is designed to maintain a high level of service performance and resource distribution across all users. While we offer unlimited bandwidth and disk space, these resources are subject to reasonable usage limits based on typical usage patterns. If we detect any activity or usage patterns that are detrimental to the stability and performance of our services, such as excessive CPU usage, overuse of resources, or activities that may harm our infrastructure, we reserve the right to suspend, terminate, or otherwise modify the Client’s account. Such actions will be taken at our sole discretion and may occur without prior notice. Smilehostie values its commitment to fairness and reserves the right to determine what constitutes excessive or harmful usage based on our established guidelines.

4. Prohibited Content and Activities

Smilehostie maintains a strict policy regarding the type of content hosted on its servers and the activities performed by its users. We do not, under any circumstances, permit the hosting or distribution of illegal content, including but not limited to pornography, phishing schemes, malware, or other malicious activities that violate laws or infringe upon the rights of others. Clients who engage in these activities will face immediate suspension or termination of their account, without prior warning. Additionally, we comply with the Digital Millennium Copyright Act (DMCA) and promptly respond to any claims of copyright infringement. As part of our commitment to maintaining a lawful and ethical hosting environment, we reserve the right to monitor, remove, or block any content or services deemed to be in violation of these prohibitions.

5. Customer Support

SmileHostie provides multiple channels for Client support, including telephone, email, ticket-based support, and WhatsApp. Our Customer Support team is dedicated to addressing Client inquiries and concerns in a timely and efficient manner. We make every reasonable effort to respond to all support requests within 24 hours of submission. While we strive to provide prompt assistance, response times may vary based on the nature and complexity of the request. SmileHostie is committed to delivering the highest level of customer service and technical support to ensure that your hosting experience is smooth and uninterrupted.
Support is available 24/7; however, 24/7 does not mean you will receive an instant reply. Response times may depend on ticket volume and issue priority. Additionally, WhatsApp support is strictly limited to chat-based assistance only, and calling through WhatsApp is not supported or permitted. For detailed technical issues or investigations, Clients must open a support ticket via the official Client Area.

6. Lawful Use Only

Smilehostie’s services are intended solely for lawful and legitimate purposes. Clients are expressly prohibited from using our hosting services to engage in activities that violate any applicable local, national, or international laws, regulations, or ordinances. This includes, but is not limited to, the transmission of unlawful, defamatory, obscene, offensive, or harmful material, or any activities that infringe upon the intellectual property rights of third parties. Clients who engage in such prohibited activities will have their accounts suspended or terminated without prior notice, and legal action may be pursued if deemed necessary by the Company. It is the responsibility of the Client to ensure that their use of our services does not result in any legal or regulatory violations.

7. Account Security

Clients are solely responsible for the security of their account information, including usernames, passwords, and any other sensitive credentials associated with their Smilehostie account. Clients must take all necessary precautions to protect their account from unauthorized access or use. In the event of any security breach or suspicion of unauthorized activity, it is the Client's responsibility to notify Smilehostie immediately. We will make reasonable efforts to assist with securing the account, but Smilehostie is not liable for any losses or damages arising from a failure to maintain adequate security.

8. Service Uptime

Smilehostie aims to maintain an uptime of 99.9% for all of our hosting services. However, we acknowledge that technical issues may arise from time to time, which could result in service interruptions or downtime. These interruptions may be caused by factors such as network outages, server maintenance, or hardware malfunctions. While we strive to minimize such occurrences, Smilehostie will not be held liable for any damages, losses, or disruptions resulting from service downtime. Clients are encouraged to back up their data regularly to mitigate the potential impact of service interruptions.

9. Email Usage Limits

Clients utilizing Smilehostie's email services are expected to adhere to reasonable usage standards. Our email services are intended for typical personal or business use and are not designed to accommodate bulk email campaigns, mass marketing, or the distribution of unsolicited emails (spam). Any activity that results in server overloads, the blacklisting of our email servers, or the disruption of services for other Clients will result in immediate suspension of the Client’s email services. Smilehostie reserves the right to implement and enforce any limits on email usage deemed necessary to maintain the integrity and functionality of our systems.

10. Data Backup Policy

SmileHostie offers automated backups for shared hosting accounts. Depending on the hosting plan selected by the Client, backups may be taken on a daily, weekly, or monthly basis. These backups are provided as an additional service to assist Clients, but Clients remain fully responsible for maintaining their own local copies of all important data.
While we make every reasonable effort to ensure the integrity and availability of backups, we do not guarantee data recovery in all situations, including but not limited to hardware failure, system errors, malware infections, or accidental deletion by the Client. SmileHostie shall not be held responsible for any kind of data loss, whether partial or complete.
Clients are strongly advised to maintain their own frequent local backups, especially if the data is critical to their operations. Relying solely on server-side automated backups is not recommended. Regular personal backup practices are essential to ensure the protection and availability of Client data.

11. Unpaid Invoice and Service Termination

If the Client fails to pay the outstanding invoice for hosting services within 3 days after the service expiry, a penalty fee of 10% of the due amount will be applied to the total invoice. The Client has a total grace period of 15 days from the expiration date of the hosting service to make the payment. If the payment is not made within this 15-day period, the Client will no longer be able to renew or reactivate the hosting plan. After the 15-day period, the hosting plan will be permanently terminated, and all associated services will be deactivated. Clients are strongly encouraged to settle their invoices within the allowed grace period to avoid penalties and ensure continued service availability.

12. Payment and Renewal

All payments for hosting services and related products must be made in full by the due date. Failure to make timely payments may result in account suspension or termination. Hosting accounts are subject to automatic renewal unless the Client cancels the service prior to the renewal date. Clients will be notified of upcoming renewals, and it is the Client's responsibility to ensure that payment details are accurate and up to date.

13. Affiliate Program Terms

Smilehostie’s Affiliate Program offers commission on hosting service purchases made through referral links. Please note that commissions are only applicable for hosting services and do not apply to domain registrations, renewals, or server purchases. Smilehostie reserves the right to disqualify affiliates who engage in fraudulent or unethical activities, including but not limited to misrepresenting our services or engaging in deceptive marketing practices.

14. Privacy Policy

At Smilehostie, we take your privacy seriously. For detailed information regarding the collection, use, and protection of personal data, please refer to our Privacy Policy. Your personal information is collected and processed in accordance with applicable data protection laws, and we are committed to safeguarding your privacy.

15. Refund and Cancellation Policy

Smilehostie offers a refund policy for hosting services, allowing Clients to cancel within seven (7) days from the date of purchase for a full refund. However, this policy does not apply to domain registrations, VPS, dedicated servers, or any additional services. Refunds for hosting services are processed promptly within 48 hours of cancellation approval and typically reflect within five (5) business days. In cases where Clients attempt to manipulate the system by creating multiple accounts to claim multiple refunds, Smilehostie reserves the right to suspend or terminate the offending accounts.

16. Changes to Hosting Resources and Features

SmileHostie reserves the right to modify, add, remove, upgrade, or downgrade any hosting resources, features, server configurations, or service components included in any hosting plan at any time and without prior notice to the Client. This includes but is not limited to changes in storage allocations, bandwidth limits, software availability, control panel features, security tools, and other service-related resources. By purchasing or continuing to use any hosting plan from SmileHostie, the Client agrees that such changes may occur and accepts that no compensation, refund, or liability shall arise from these modifications.

17. Changes to Terms of Service

Smilehostie reserves the right to modify, update, or change these Terms and Conditions at any time. It is the Client’s responsibility to review these terms periodically. Continued use of Smilehostie’s services constitutes acceptance of any modifications. The most current version of the Terms and Conditions will always be available on our website.
